Terms and Conditions of the Use of xBeeFi Beta App

1. Acceptance of Terms

By accessing the xBeeFi Beta App ("the App") located at https://app.xbeefi.com and using its services, you ("the User") agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you will only have read-only access to browse the App. You will not be able to create an account, stake-to-predict, claim winnings, or withdraw any $HUSD. These Terms should be read in conjunction with the Beta App Disclaimer presented upon launch.

2. Eligibility

Access to the App's full functionality is restricted to: (a) individuals who are invited by xBeeFi; (b) holders of xBeeFi NFTs; and (c) a limited number of users who have completed account registration, all subject to applicable local laws and regulations. xBeeFi reserves the right to revoke access to the App at any time for any reason. You must be at least 18 years of age to use this App.

3. Beta Status and Disclaimer of Warranty

The App is a Beta version and is provided "as is" and "as available" without any warranties of any kind, express or implied. xBeeFi does not warrant that the App will be error-free, uninterrupted, or free of viruses or other harmful components. xBeeFi will not be liable for any losses suffered by you as a result of using this Beta App.

4. Limited License

xBeeFi grants you a limited, non-exclusive, non-transferable, revocable license to use the App solely for testing and feedback purposes. This license is subject to your compliance with these Terms.

5. Use of Pre-loaded $HUSD

The App provides Users with pre-loaded $HUSD for testing purposes. This $HUSD has no real-world value and is not redeemable for any other asset, except as explicitly provided by xBeeFi as rewards. Users may use the $HUSD to:

• Participate in stake-to-predict activities.
• Claim winnings (in $HUSD).
• Withdraw $HUSD to their individual wallet as rewards.

6. Restrictions

Users are strictly prohibited from:

• Attempting to deposit assets into the App through unofficial channels (deposit functionality is disabled).
• Attempting to redeem $HUSD for any other asset (this feature is disabled).
• Using the App for any illegal or unauthorized purpose.
• Attempting to reverse engineer, decompile, or disassemble the App.
• Violating any applicable laws or regulations.
• Using any robot, spider, crawler, scraper, or other automated means or interface not provided by us, to access the service or to extract data.
• Providing false, inaccurate, or misleading information.
• Engaging in any activity that could disrupt the Service or another Customer using the Service.
• Using the service from a jurisdiction that we have, in our sole discretion, prohibited.

7. Unauthorized Deposits

Deposit functionality is disabled in the Beta App. If you attempt to deposit assets through any unofficial channel, xBeeFi does not guarantee that those assets will be returned.

8. Account Security

It is Your sole and exclusive responsibility to ensure that Your login details are kept securely. You must not disclose Your login details to anyone. We are not liable or responsible for any abuse or misuse of Your account by third parties due to Your disclosure of Your login details. You are responsible for all activities that occur under Your account.

9. Suspension and Termination

xBeeFi may suspend or terminate your access to the App at any time, with or without cause, including but not limited to:

• If xBeeFi suspects you are using the App in a fraudulent or collusive manner.
• If required to do so by law or regulatory authority.
• If you breach these Terms.
• If xBeeFi suspects you are a problem user.
• If xBeeFi believes your account has been compromised.

In the event of termination, xBeeFi will determine, in its sole discretion, whether any remaining $HUSD balance will be returned to you.

10. Intellectual Property

The App and its content, including but not limited to text, graphics, logos, and software, are the property of xBeeFi and are protected by copyright and other intellectual property laws. You are granted a limited license to use the App for testing purposes only. You may not copy, modify, distribute, or create derivative works from the App without xBeeFi's express written consent.

11. Data Collection and Privacy

xBeeFi may collect data related to your use of the App for testing and improvement purposes. By using the App, you consent to the collection and use of your data in accordance with xBeeFi's privacy policy (which should be linked here if available).

12. Limitation of Liability

To the fullest extent permitted by law, xBeeFi shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the App, even if xBeeFi has been advised of the possibility of such damages. This includes, but is not limited to, losses due to errors, bugs, or interruptions in the App.

13. Indemnification

You agree to indemnify and hold harmless xBeeFi and its affiliates from any claims, damages, or expenses arising out of your use of the App or your breach of these Terms.

14. Fair Use

You must otherwise generally act in good faith in relation to us of the service at all times and for all stake-to-predict activities made through the service.

15. Unacceptable Use or Conduct

As a condition to accessing or using the service, you will not:

• Violate any applicable law.
• Infringe on or misappropriate any contract, intellectual property or other third-party right, or commit a tort while using the services.
• Use the service in any manner that could interfere with, disrupt, negatively affect, or inhibit other users from fully enjoying the service, or that could damage, disable, overburden, or impair the functioning of the service in any manner.
• Attempt to circumvent any content filtering techniques or security measures that xBeeFi employs on, or attempt to access any service or area of the service that you are not authorized to access.
• Use the service to pay for, support, or otherwise engage in any illegal activities, fraud, or other illegal activities.
• Introduce any malware, virus, Trojan horse, worm, logic bomb, drop-dead device, backdoor, shutdown mechanism or other harmful material into the service.
• Post content or communications on the service are, in our sole discretion, libelous, defamatory, profane, obscene, pornographic, sexually explicit, indecent, lewd, vulgar, suggestive, harassing, hateful, threatening, offensive, discriminatory, bigoted, abusive, inflammatory, fraudulent, deceptive or otherwise objectionable.
• Post content on the service containing unsolicited promotions, political campaigning, or commercial messages or any chain messages or user content designed to deceive or trick the user of the service.
• Use the service from a jurisdiction that we have, in our sole discretion, prohibited.

16. Changes to Terms

xBeeFi may modify these Terms at any time by posting the revised Terms within the App. Your continued use of the App after such changes constitutes your acceptance of the revised Terms.

17. Entire Agreement

These Terms constitute the entire agreement between you and xBeeFi relating to your use of the App.
